Reflecting on London International Disputes Week (LIDW)

On Thursday 5 June, our Funding Partner participated as a panelist in London International Disputes Week (LIDW) in the session “Old Dog, New Tricks: How ISDS Must Innovate to Resolve the Disputes of the Future.”

Together with fellow experts — Rahul Donde, Ahmed Khafagy (Ministry of Foreign Affairs, Egypt), Katrina Limond (A&O Shearman), and Maxim Osadchiy FCIArb — we explored pressing questions about the legitimacy of the Investor-State Dispute Settlement (ISDS) system and how it must adapt to address the realities of a rapidly changing global landscape.

Key Issues Discussed

New and evolving sources of disputes driven by digital transformation, energy transition, climate change, and the challenges of operating in times of armed conflict.
Emerging challenges in technology sectors such as 5G/6G, satellite networks, cloud infrastructure, and the Internet of Things (IoT).
The impact of artificial intelligence on both the substance of investment disputes and on arbitration procedures themselves — raising vital questions about efficiency, fairness, and legitimacy.

Cindy Rayo moderated an insightful panel during Washington Arbitration World update (WAW) 2025.

Special thanks to RRH Consultores & Washington Arbitration Week for the kind invitation and to our brilliant panelists Gabriela Alvarez Avila José Ramón Cossío Díaz @AndreaOrnelas @EduardoSiqueiros for such a dynamic and thoughtful exchange. The key points of the conversation were on whether the Mexican judicial reform could amount to a denial of justice under the standards of Fair and Equitable Treatment (FET) and the Minimum Standard of Treatment (MST).

These conversations matter—especially when legal reforms raise fundamental questions about international obligations, rule of law, and investor protections.

Nuestra Socia Fundadora participo como moderadora en el evento «Escudo fiscal y administrativo 2.0: estrategias innovadoras en arbitraje de inversión frente a créditos fiscales y otros actos de autoridad”.

Presentar a los asistentes cómo el arbitraje de inversión permite impugnar créditos fiscales y otros actos de autoridad. Esta iniciativa nace derivado del déficit fiscal que enfrenta México, las recientes interpretaciones arbitrarias del SAT (sin reformas de ley) y algunos casos como el de aseguradoras que han iniciado arbitraje y otros casos anteriores (Coeur Mining, devoluciones de IVA; First Majestic, doble tributación; Cargil, ADM y CPI, IEPS a la fructosa; Feldaman, relacionado a impuestos, entre otros).

During the event she mentioned that the global economy is increasingly driven by knowledge-based services, where intellectual property (IP) charges, data protection, and free flow of data are shaping new regulatory landscapes.

I highlighted how international businesses are navigating the complex regulatory landscapes and the interplay between intellectual property rights and data protection laws in the era of digital trade and Knowledge intensive business services.

Key Points:

-By 2035, over 50% of China’s service trade will be digital.
-IP charges represent 15.6% of digital service trade in APEC.
-Sectors like AI, SaaS, and streaming are redefining the IP landscape.
-For businesses that rely on knowledge-based services access to data across borders is essential.
-The legal landscape is becoming increasingly restrictive and fragmented.

However, divergent regulations on data protection, stricter regulations on cross border data flows and data localization requirements are creating new risks and disputes are becoming more common:

• Who owns an AI-generated model trained with data licensed from different jurisdictions?
• What happens when a software company is restricted from processing user data due to new privacy regulations, violating contractual terms with a client?
• How do companies resolve conflicts when a government’s data laws block the execution of an IP licensing agreement?

International arbitration emerges as a key solution to navigate these challenging legal and regulatory frameworks.
