She highlighted how international businesses are navigating the complex regulatory landscapes and the interplay between intellectual property rights and data protection laws in the era of digital trade and Knowledge intensive business services.

• By 2035, over 50% of China’s service trade will be digital.
• IP charges represent 15.6% of digital service trade in APEC.

However, divergent regulations on data protection, stricter regulations on cross border data flows and data localization requirements are creating new risks and disputes are becoming more common:

• Who owns an AI-generated model trained with data licensed from different jurisdictions?
• What happens when a software company is restricted from processing user data due to new privacy regulations, violating contractual terms with a client?
• How do companies resolve conflicts when a government’s data laws block the execution of an IP licensing agreement?

International arbitration emerges as a key solution to navigate these challenging legal and regulatory frameworks.
