Reflecting on London International Disputes Week (LIDW)

On Thursday 5 June, our Funding Partner participated as a panelist in London International Disputes Week (LIDW) in the session “Old Dog, New Tricks: How ISDS Must Innovate to Resolve the Disputes of the Future.” Together with fellow experts — Rahul Donde, Ahmed Khafagy (Ministry of Foreign Affairs, Egypt), Katrina Limond (A&O Shearman), and Maxim Osadchiy FCIArb — we explored pressing questions about the legitimacy of the Investor-State Dispute Settlement (ISDS) system and how it must adapt to address the realities of a rapidly changing global landscape.

Key Issues Discussed

  • New and evolving sources of disputes driven by digital transformation, energy transition, climate change, and the challenges of operating in times of armed conflict.
  • Emerging challenges in technology sectors such as 5G/6G, satellite networks, cloud infrastructure, and the Internet of Things (IoT).
  • The impact of artificial intelligence on both the substance of investment disputes and on arbitration procedures themselves — raising vital questions about efficiency, fairness, and legitimacy.
